Banking Act 2009 special resolution regime: code of practice
The Code of Practice, issued in accordance with sections 5 and 6 of the Act, supports the legal framework of the special resolution regime, and provides guidance as to how and in what circumstances the Authorities will use the special resolution tools.
The Treasury has issued the Code having consulted the Financial Services Authority, the Bank of England and the Financial Services Compensation Scheme in accordance with section 6 of the Act. The Code was laid before Parliament on 23 February 2009.
The Treasury will formally consult the Banking Liaison Panel, a statutory body that has the role of advising the Treasury on certain matters relating to the special resolution regime, and a new Code will be issued in due course.
