Banking Act 2009 special resolution regime: code of practice
The Code of Practice, issued in accordance with sections 5 and 6 of the Act, supports the legal framework of the special resolution regime, and provides guidance as to how and in what circumstances the Authorities will use the special resolution tools. The Code was first laid before Parliament on 23 February 2009.
The Treasury has now issued a revised the Code, having consulted the Financial Services Authority, the Bank of England and the Financial Services Compensation Scheme in accordance with section 6 of the Act, and the Banking Liaison Panel. The revised Code was laid before Parliament on 22 November 2010.
